Court to Reexamine Ruling That Permitted Trump to Deploy Troops to Oregon City

The ninth circuit court has maintained a prohibition on sending national guard in Portland, Oregon, after a recent court ruling.

Appeals Court Concurs to Reconsider Case

The ninth circuit court of appeals decided on Tuesday that it would reexamine the legal dispute concerning the executive power with an expanded panel of eleven justices. The judicial body also overturned a earlier ruling from a smaller judicial group that had sided with the administration.

Legal Saga Over Troop Deployment

This legal directive represents the most recent turn in a long-running legal battle over whether the administration has the legal right and justification to deploy state military units in Portland. Approximately two hundred troops have been in limbo since late September when the mobilization attempt was initiated in due to months of protests.

Differing Viewpoints

The administration has claimed that government employees at the immigration center in the southern part of the city were facing threats, while local authorities assert that local officers have command of the circumstances.

Contrary to descriptions of the city as “war ravaged”, locals have been sharing footage of lush hiking trails and a thriving food scene, and organizing events such as an Emergency Naked Bike Ride against the “militarization of our city”.

Court Proceedings

The appeals court decision came after a federal judge in the city issued two legal injunctions this month – one blocking the federal control of the state troops, and another stopping the use of any military personnel in Oregon, after attempts to circumvent the initial injunction by mobilizing troops from California.

On the previous day, the ninth circuit panel had temporarily suspended the initial decision – allowing control of state troops – but the second ruling stayed effective, preventing the physical sending of the troops.

The latest ruling means the matter will be heard by the full court – with all decisions under review simultaneously – by a group of 11 judges.

“This decision demonstrates that facts are important and that the courts are working to hold this administration accountable. The founding document limits the president’s power, and Oregon’s communities cannot be treated as a training ground for expansive government power,” stated the legal representative in a official comment.

“The judicial body is sending a clear message: the president cannot send the armed forces into American urban areas unnecessarily. We will continue defending state legislation, values, and sovereignty as this case progresses and our fight continues in the courts.”
